Applicability of this Policy

This policy is applicable to the website JoshMoulin.com (“Website”), which is owned and operated by Joshua S. Moulin (“We, “Us, “Our,” or “Owner”).  This policy also applies to any social media sites or accounts also operated by Us that are directly accessible through the Website.  The policy applies to all persons who lawfully access such services, websites, or social media sites/accounts (“You,” “Your,” or “User”).  This policy does not apply to persons who illegally access any service or Website or who access any service or Website in violation of the applicable Terms and Conditions.

Information we Receive about You

If you choose to create a User Account in order to access additional information that is only available to Our members, you will be required to provide some basic personal information about yourself.  This information includes your name and email address. If content is uploaded to this website, including a comment, the IP address of the system posting content is captured. Any login to this website also captures the IP address of the system authenticating to the web server. This information is collected and retained for up to two years for security reasons and to identify malicious activity or attempted malicious activity. Usernames, hashed passwords, email addresses, and comments posted are stored indefinitely or until the account is deleted by the user.

User Profile

After creating a user profile, you will have the opportunity to customize your profile.  The information provided to create your customized profile is completely controlled by you.  You may include as much or as little information as you would like in your user profile and you may even upload a photo of yourself as your avatar.

Subscriptions to email Lists

You may choose to sign up for email notifications about updates to JoshMoulin.com.  At no time will your personal information be provided to or sold to commercial companies for the purposes of advertising.  Any email lists you sign up on within the JoshMoulin.com website will be used exclusively for content specifically related to our website.

When we will Disclose Your Information

Law Enforcement Verified Emergency Purposes

Prior to providing law enforcement officials with any information or data collected on Our Website, We will ensure the proper legal process has been followed pursuant to the Electronic Communications Privacy Act (“ECPA”), Stored Communication Act (“SCA”) or other applicable laws.  The only exception is when law enforcement can articulate an exigent circumstance and they need data from our Website (e.g., someone’s life is in danger).  A written affidavit stating the facts will be required prior to releasing any information in an exigent circumstance case.

In Response to Appropriate Legal Process

We will produce any requested data that is lawfully and properly requested by service of legal process (subpoena, administrative order, or search warrant) pursuant to the ECPA, SCA, or other applicable laws.

What we Never do with Information We Collect or Receive

We never sell or lend personal information we collect from or about you to any third-party for commercial purposes. For purposes of this statement, We define “personal information” as information we possess from or about You, that can be readily correlated with You as an individual person. For example, your address, Your individual user habits, or Your credit card information, would all constitute personal information. In contrast, a geographical count of users residing in a certain geographical area (without providing names), aggregate data about how many users have certain user habits, and how many users purchased a certain service using credit cards, would not be personally identifiable with you individually, and therefore would not constitute personal information.

In the case of credit card information necessary for a purchase transaction, we utilize a payment processor gateway that collects all of your information directly onto their secure servers. None of Our servers or resources keep any of your credit card information at any time.

How We Use Information We Collect or Receive

Your email address, real name (unless you choose to publicly share it) or other contact information are considered Personal Information.  We do not make your Personal Information publicly visible or available, We do not allow other Users to access this information, and do not place this information in any portion of the Website that are available to be crawled or indexed by search engines.

We may contact you via your email address or other provided contact information, for customer service or administrative matters.  We may use your Personal Information to assist us in improving user experience and safety/security of our services.  We may also use your Personal Information as necessary if we need to address or investigate a complaint about violation of the Acceptable Use Policy.

Public Information

All information or data that is not Personal Information (as defined above) is considered Public Information.  This includes data and information you voluntarily place in your User Profile, comments you submit in response to blog postings or articles, and postings or messages you post in any User or Member forums.  Public Information may be indexed by and visible via commonly used Internet search engines such as Google or Yahoo!  We do not manage, moderate, or delete Public Information unless they violate Copyright Law, Trademark Law, or violate our Acceptable Use Policy.  If you decide to cancel your account, while your User Profile will be deactivated and archived and therefore no longer accessible to other users and the public, it may not be fully deleted.  Furthermore, cached versions of your User Profile may be available throughout the Internet from sources other than servers or networks that We operate or use.

Commercial Solicitations

Aggregate Data

We reserve the right to use Aggregate Data for any legitimate business purpose including business functions that involve sharing such data with other companies, individuals, or organizations. This may include, but is not limited to, improving security, enhancing the user experience, planning for expansion of service resources, or for enforcement of the Acceptable Use Policy. Public Information will continue to be available to the public even after you cancel your account.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
